Work Permits must usually be applied for at a Canadian visa office outside Canada, or in some exceptional cases, at the airport or Canadian port-of-entry. Most of the time, a foreign worker applicant must first obtain a job offer approved by Canada’s Human Resources and Skills Development (HRSDC) before applying for a Work Permit to the Canadian visa office. An employer facing a labour shortage in Canada may be eligible to hire a foreign worker. The employer must demonstrate the reasons why they could not find a Canadian or a permanent resident to fill this labour shortage despite of their continuous recruitment and advertising efforts. Proofs of recruitment and advertising efforts are just some of the factors that HRSDC consider in assessing the job offer.
Once the employer agrees with the terms and conditions of the Foreign Worker Program and has met the requirements of HRSDC in hiring a foreign worker, a Labour Market Opinion (LMO) has to be submitted for review.
Approval or refusal of the application will be sent to the employer informing about the decision. If a positive decision has been given, the foreign worker may now apply for a Work Permit to the appropriate Canadian office. Kabayan Immigration assists employers in filing the LMO application. Once a positive LMO has been issued, we can also assist in the filing of the Work Permit application for the foreign worker. Citizenship and Immigration Canada (CIC) will determine if the foreign worker’s admissibility to Canada before issuing a Work Permit. Processing times for Work Permit applications vary from which visa office the application was sent to.
